Terms of Use for PoeticÁI

These terms (the “PoeticÁI Terms”) govern your use of the PoeticÁI mobile application (the “App”), published by Itch Studio Ltd. (“Itch Studio”, “we”, “us”, or “our”). By using the App you agree to them. If you do not agree to them, please do not use the App.

They sit alongside our general App Terms of Use, which cover licensing, restrictions, intellectual property, disclaimers, limitation of liability, and termination for all Itch Studio apps. Both apply. Where the two differ on a point, the PoeticÁI Terms on this page prevail.

These terms are published in English and apply worldwide. Nothing here affects the statutory rights you have as a consumer in your own country.

1. What the App is for

PoeticÁI writes poems. You choose an occasion or a subject, a poet to write in the manner of, a form and a mood, and an AI model returns a poem, optionally with an illustration. It is intended for entertainment and, in a limited way, for learning something about poetic form.

The App is intended for people aged 13 or over.

2. There is no subscription

This section replaces the auto-renewing subscription terms in our general App Terms of Use. Those terms cover every Itch Studio app, some of which do offer subscriptions. PoeticÁI does not, and there is no auto-renewal of any kind.

Everything in PoeticÁI is either free or a one-off purchase. Nothing expires and nothing renews. There is no trial that turns into a bill.

3. Illustration credits

Illustrations are paid for with credits, sold as a one-off purchase in packs. Credits do not expire. We may change the price or the pack sizes at any time, and we may stop selling them, but credits you have already bought remain usable.

Purchases are processed by the Apple App Store under Apple's terms and payment policies. We never see or store your payment details. Refunds are handled by Apple in accordance with its policies. If a technical fault on our side prevents you using credits you have paid for, contact us and we will put it right.

4. Patron

Patron is a single payment that unlocks the whole catalogue permanently: every poet, every form, subjects in your own words, and illustrations without counting credits. It is not a subscription and it will not become one. It is tied to the Apple ID that bought it and restores on any device signed in to that account.

5. The poems and illustrations you make

Poems and illustrations you generate are yours. Keep them, print them, put them in a card, read them aloud at a wedding or a funeral, post them, or sell them. No credit to us is required.

We do not claim ownership of anything you generate. We ask for one narrow permission: a non-exclusive, worldwide, royalty-free licence to use, copy, modify, display and distribute generated content for the purpose of improving the App, showing examples of what it produces, and promoting it.

That licence covers content you choose to share with us, for example in a support message, a review, or a bug report. It does not give us access to the poems on your device. Poems stay on your device unless you send them somewhere yourself, and we have no way to read them. See the PoeticÁI Privacy Policy for what actually leaves the device.

6. The poems are written by a machine

Poems and illustrations come from an AI model. The model is good at form and often surprising, but it is not a poet and it does not know what it means. It can be confidently wrong about names, dates, places, and anything else it was not told.

Treat what comes back as a first draft rather than a fact. Check anything you intend to read aloud, print, or attach a person's name to. Nothing the App produces is professional, medical, legal, financial or other specialist advice, and you should not rely on it as such.

Two people making the same choices may receive similar poems. The App does not promise that any output is unique.

7. Writing in the manner of a poet

Every poet you can choose in the App is long out of copyright, and none of their words appear in it. What the App offers is an impression of a manner of writing, assembled by a machine that has read them. It is homage, not their work, and it should not be presented as their work.

The short biographies in the App are provided for interest. They are compiled from general reference sources and may contain errors.

8. Using the App properly

You are responsible for what you type into the App and for what you do with what it returns. You agree not to use the App to create or share content that is unlawful, that harasses or defames someone, or that infringes anybody else's rights.

You also agree not to attempt to overload, probe, or interfere with the service that generates poems, and not to use it other than through the App itself.

9. Reporting content that infringes your rights

We respect other people's intellectual property. If you believe something the App has produced or published infringes your rights, write to info@itch.studio with:

We will investigate promptly and remove infringing content where that is the right outcome.

10. Availability

Writing a poem needs a network connection and our service to be reachable. We do not promise that the service is available without interruption, and we may change or withdraw parts of the App. Poems already saved on your device remain readable offline whatever happens to the service.

Older versions of the App may stop working when the service they were built against is retired. We will make an update available before that happens where we reasonably can.

11. Disclaimers and liability

The disclaimers and the limitation of liability in our general App Terms of Use apply to PoeticÁI and are incorporated here.

Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

12. Your data

What the App collects, what it sends, and what stays on your device is set out in the PoeticÁI Privacy Policy, which forms part of these terms.

13. Changes to these terms

We may update these terms. The version on this page is the one that governs, and the date at the top tells you when it last changed. Where a change matters, we will say so in the App. Continuing to use the App after a change takes effect means you accept the revised terms.

The App also carries a copy of these terms for reading offline. That copy is a snapshot taken when that version was released and can only change in an App Store update, so if the two ever differ, this page is the one that applies.

14. Governing law

These terms, and any dispute or claim arising out of or in connection with them, including non-contractual disputes or claims, are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere you may also bring proceedings in the courts of the country you live in, and you keep the protection of any mandatory consumer law there.
